The Challenge

A defendant and sole director faced a claim alleging breach of an oral agreement to transfer 50% company ownership to the claimant, requiring expert valuation evidence to defend the action. Obtaining financial information proved challenging due to a language barrier, requiring persistent communication to establish complete facts.

Our Approach

BTG was engaged as expert witness accountant to value the company and assess a 50% ownership interest. Our team reviewed substantial disclosure, analysed investment holdings, and maintained persistent engagement despite language barriers. We produced a comprehensive expert report, held meetings with the opposing expert identifying fundamental errors in their analysis, and produced a clear Joint Statement summarising key differences.

The Outcome

BTG provided the required evidence during trial, with the defendant successfully defending the case. The Deputy Judge commented that we gave evidence "in an impartial, clear and direct fashion, borne out of a deep expertise of the subject matter," demonstrating our forensic accounting capabilities in complex shareholding disputes.
